Source-Separated Recycling Ordinance: State of New Jersey
This recycling ordinance was created by the State of New Jersey’s Department of Environmental Protection for municipalities to develop source separated collection of recyclables. The ordinance mandates separation of recyclables for all individuals, businesses, and institutions. It outlines receptacle maintenance, placement, and other health related codes. Multi-family building owners are responsible for their tenants, and commercial properties are responsible for providing recycling receptacles in all areas with trash disposal. Food service establishments are required to recycle cooking oils and maintain records for inspectors.
The ordinance also includes a requirement that multi-family residential, commercial, institutional, and industrial projects submit a recycling plan with detailed analysis of expected waste generation, and documented locations for convenient collection of recyclables. Prior to the issuance of a Certificate of Occupancy, all new developments must show proof of a hauling contract for source-separated recyclables. This ordinance has generic language that can be adapted for different municipalities, and has notes that offer alternatives to the wording provided. Not all municipalities will be able to achieve all of the measures outlined in this policy, but it covers most of the areas that any city would be interested in addressing.
