Burlington, Vermont Inclusionary Zoning and Density Bonus Ordinance

Mixed-income housing, in addition to creating housing units for occupancy by low-income households, also contributes to the diversity and stability of American communities. This ordinance, developed by the City of Burlington, Vermont, is designed to require mixed-income housing for all multi-family and for sale housing. 8 pages 

This ordinance requires that all development of multi-family projects include 15% inclusionary housing. In addition, developments of for-sale housing must include up to 25% inclusionary housing. The ordinance ties the required amount of inclusionary housing to the percentage of income above Area Median Income (AMI). In lieu of fees, the ordinance establishes a housing trust fund.
 
This ordinance is ideal for governments wishing to mandate inclusionary housing in all developments with more that 10 units. In addition, this ordinance is useful for those governments wishing to tie inclusionary unit ratios with the percentage of market rate units and their relation to AMI.
